Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and Stage productions ("Company", "we", "us", or "our") concerning your access to and use of our services.

By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our services.

Services

Stage productions provides retail services as described on our website. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

Payment Terms

If you purchase services from us:

• Prices are in Australian Dollars (AUD) and include GST where applicable
• Payment is due as specified in your service agreement or invoice
• We accept payment methods as displayed on our website
• Late payments may incur additional fees or result in service suspension
• All sales are final unless otherwise stated in our refund policy

Cancellation and Refunds

Under the Australian Consumer Law, you are entitled to:

• A refund or replacement if goods or services are faulty, not fit for purpose, or don't match their description
• Cancel services within a cooling-off period if applicable under law
• Remedies for problems that would not normally be expected based on the nature of the product or service

Please contact us to discuss cancellation or refund requests. Our guarantees under Australian Consumer Law cannot be excluded.

Limitation of Liability

To the maximum extent permitted by Australian law:

• We provide our services "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim

Nothing in these Terms limits or excludes our liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited or excluded under Australian law.

Indemnification

You agree to indemnify and hold harmless Stage productions and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services or breach of these Terms.

Dispute Resolution

If a dispute arises between you and Stage productions:

• We encourage you to first contact us to resolve the matter informally
• If the matter cannot be resolved, you may seek resolution through mediation or arbitration
• These Terms are governed by the laws of South Australia, Australia
• The courts of South Australia have exclusive jurisdiction over disputes

Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services supplied again if they fail to be of acceptable quality and the failure does not amount to a major failure.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use our services will immediately cease.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of our services after changes constitute acceptance of the new Terms.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
